File this story under a lot of things. Gross overreach by local police; a basic misunderstanding of teenage relationships and seriously antiquated laws.
But I promise you will enjoy the story. And be appalled. The background is that a 17-year-old boy in Prince William County, Virginia was caught sending a sexually explicit picture message to a 15-year-old girl. They were dating at the time, and she had sent him nude photos as well.
Not great, but like, whatever. This is probably a situation wherein some parents should jump in and be like, guys, chill with the nude pics to each other. You’re young. Honest mistake.
Instead, the girl’s mom went to the police, and now the boy is facing felony charges of both possessing and manufacturing child porn. Possessing for having pictures the girl sent him and manufacturing for snapping a picture of his own dick. The penalties are serious, too.
The teen is facing two felony charges, for possession of child pornography and manufacturing child pornography, which could lead not only to incarceration until he’s 21, but inclusion on the state sex offender data base for, possibly, the rest of his life.
Even if you can get past this absurdity, wait until you read the lengths prosecutors in Virginia are willing to go to prosecute the case.
Prince William County prosecutors want to take a photo of his erect penis, possibly forcing the teen to become erect by taking him to a hospital and giving him an injection, the teen’s lawyers said.
They’ll then compare that photo to the dick pic to see if that dick is his dick. Totes reasonable. The warrant has yet to be served, though, and the boy has left the state to avoid it (with a judge’s permission).
